DespitethesetbacksencounteredinthenegotiationofmultilateralforeigninvestmentrulesattheWorl
TradeOrganizationandFreeTradeAreaoftheAmericastalks,thereisstillaframeworkofrulesgovernin
investmentemergingintheAmericas.Althoughincompleteandembryonic,theemergingforeig
investmentregimeisdefinedbytheexistingmulti-layeredpatchworkofprimarilybilateralinvestmen
agreementsandinvestmentchaptersoffreetradeagreements. But,theshiftfromnegotiatin
investmentrulesinaregionalormultilateralforumtoapredominantlybilateraloneislikelytohav
consequencesforthecharacterofthatinvestmentregime.Thispaperexaminesthenatureofthi
emergingforeigninvestmentregimeintheAmericas.Itbeginsbydiscussingthestateoftheglobalan
hemisphericnegotiationsoninvestmentrules,andthepositionoftwoofthehemisphere'smos
importantplayers,theUnitedStatesandBrazil,onthisissue.Thenatureoftheinvestmentregimedesire
bybothplayersisthenexaminedthroughananalysisofthebilateralinvestmentagreementsconcludedb
bothwiththeirLatinAmericanpartners.
